A Power of Attorney is a legal document in which you name someone to make decisions for you when certain events occur.  The word “durable”, when used in a power of attorney, simply means that the power of attorney remains effective, even after a person becomes incapacitated.

For most clients, two powers of attorney are executed, a Durable Power of Attorney for financial decisions, and a Health Care Power of Attorney.  The terms of both power of attorneys can provide that it is effective when it is signed, or upon the happening of an event, such as a person’s incapacitation.  A power of attorney is an extremely important document for most people and having attorney with extensive experience in drafting these documents is important.
